Our registered office is: Office 8, The Link Business Centre, Tylers Ave, Southend-on-Sea, SS1 2BB. Company No: 10640529.

2. What this policy covers

This policy explains how we handle personal data under the UK GDPR and Data Protection Act 2018. It applies to: (a) visitors to our website, (b) people making enquiries about our services, (c) clients and their representatives, and (d) job applicants and staff candidates.

3. The data we collect

  • Contact details — name, email, phone, and enquiry details.
  • Care-related information — information necessary to assess needs and provide care, which may include health data and details about support networks. We only collect what is necessary.
  • Application data — CV, employment history, referees, right-to-work, DBS status where required.
  • Website data — basic technical information (e.g. IP address, device/browser), and strictly necessary cookies. We do not use analytics cookies on this page.

4. Where your data comes from

We collect data directly from you, from your authorised representative (e.g. family member or advocate), from commissioning bodies (e.g. local authorities/NHS), and from referees or background check providers for recruitment where applicable.

5. How we use your data

  • Responding to enquiries and providing information you request.
  • Assessing care needs and delivering safe, lawful services.
  • Managing referrals, care planning, scheduling and quality assurance.
  • Recruitment screening and onboarding for job applicants.
  • Compliance with legal, regulatory and safeguarding obligations.
  • Maintaining site security and preventing misuse.

6. Our legal bases

Depending on the context we rely on one or more of the following legal bases under UK GDPR:

  • Consent (Art. 6(1)(a)) — e.g. when you choose to receive a call-back.
  • Contract (Art. 6(1)(b)) — to take steps at your request prior to entering a contract or to perform a contract for care services.
  • Legal obligation (Art. 6(1)(c)) — to meet statutory requirements (e.g. CQC regulations, employment law).
  • Legitimate interests (Art. 6(1)(f)) — for running our business, site security, and responding to enquiries, provided your rights are not overridden.

Where we process special category data (e.g. health information) we rely on Art. 9(2)(h) (health or social care purposes), Art. 9(2)(b) (employment/social protection law), or your explicit consent (Art. 9(2)(a)) where required.

7. Sharing your data

We may share personal data, where appropriate and lawful, with:

  • Commissioners and regulators (e.g. Local Authorities, NHS bodies, CQC).
  • Health and social care professionals directly involved in your care.
  • Service providers who support our operations (e.g. secure IT and records systems) under contract.
  • Referees, DBS and right-to-work check providers (for recruitment).
  • Law enforcement or authorities where required by law or to protect vital interests.

We do not sell your personal data.

8. International transfers

If we transfer data outside the UK, we will do so in compliance with data protection law, using appropriate safeguards (e.g. UK IDTA, addendum to SCCs, or adequacy regulations).

9. Retention

We keep personal data only as long as necessary for the purposes set out above and to meet legal/regulatory requirements. For example:

Enquiry records
Up to 12 months after final contact, unless a service relationship follows.
Care records
In line with NHS and CQC guidance and statutory requirements (often several years after last contact).
Recruitment data
Up to 6 months for unsuccessful candidates; longer where consent is given to keep on file.

10. Your rights

Under UK data protection law you have rights including to access, rectify, erase, restrict or object to processing, and data portability. You also have the right to withdraw consent where processing is based on consent.

To exercise your rights, contact info@alphahealthandcare.co.uk. We may need to verify your identity. You can also complain to the Information Commissioner’s Office (ICO).

11. Security

We use technical and organisational measures to protect personal data, including access controls, encrypted storage where appropriate, and staff training. No system is perfectly secure; we aim to minimise risk and respond promptly to any issues.

12. Children’s data

We process children’s data only where necessary for care or safeguarding purposes and strictly in line with the law and relevant guidance.

13. Automated decision-making

We do not carry out decisions based solely on automated processing that produce legal or similarly significant effects.

14. Changes to this policy

We may update this policy to reflect changes in law or our practices. The latest version will always be available on our website.
